Welcome to Flipsy, a product of Triad Agency. These Terms of Service ("Terms") govern your use of our flashcard learning platform and services provided by Triad Agency, located at Parallel Boulevard 17A, 2202HK Noordwijk, Netherlands.

By accessing or using Flipsy, you agree to be bound by these Terms. If you disagree with any part of these terms, then you may not access our service.

2. Description of Service

Flipsy is an AI-powered flashcard learning platform that uses spaced repetition algorithms to help users learn and retain information more effectively. Our services include:

• Creating and managing flashcard decks
• AI-powered flashcard generation
• Spaced repetition learning algorithms
• Progress tracking and analytics
• Study session management

3. User Accounts

Account Creation

To use certain features of our service, you must create an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.

Account Security

You are responsible for safeguarding the password and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

4. Subscription Plans and Payment

• Up to 3 decks maximum
• 50 cards per day viewing limit

Pro Plan

• Monthly subscription: €4.99 per month
• Annual subscription: €3.99 per month (billed annually)
• 7-day free trial for new subscribers
• Unlimited decks and cards
• AI-powered card generation
• Advanced analytics

Payment Terms

Subscriptions are charged in advance on a monthly or annual basis. All payments are processed securely through our payment providers. You authorize us to charge the payment method on file for your subscription.

Cancellation and Refunds

You may cancel your subscription at any time. Cancellation will take effect at the end of your current billing period. We do not provide refunds for partial months or years, except as required by law.

5. User Content

You retain ownership of any content you create or upload to Flipsy ("User Content"). By using our service, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and display your User Content solely for the purpose of providing our services.

You are solely responsible for your User Content and warrant that you have all necessary rights to use and share such content.

6. Prohibited Uses

You may not use Flipsy:

• For any unlawful purpose or to solicit others to perform unlawful acts
• To violate any international, federal, provincial, or state regulations, rules, laws, or local ordinances
• To infringe upon or violate our intellectual property rights or the intellectual property rights of others
• To harass, abuse, insult, harm, defame, slander, disparage, intimidate, or discriminate
• To submit false or misleading information
• To upload or transmit viruses or any other type of malicious code
• To spam, phish, pharm, pretext, spider, crawl, or scrape
• To interfere with or circumvent the security features of the service

7. Intellectual Property

The Flipsy service and its original content, features, and functionality are and will remain the exclusive property of Triad Agency and its licensors. The service is protected by copyright, trademark, and other laws. You may not duplicate, copy, or reuse any portion of the HTML/CSS, JavaScript, or visual design elements without our written permission.

8. Service Availability

We strive to maintain high service availability but cannot guarantee uninterrupted access to our services. We may temporarily suspend access for maintenance, updates, or technical issues. We are not liable for any loss or damage caused by service interruptions.

9. Privacy

Your privacy is important to us. Please review our Privacy Policy, which also governs your use of the service, to understand our practices regarding the collection and use of your information.

10. Disclaimer of Warranties

The information on this service is provided on an "as is" basis. To the fullest extent permitted by law, Triad Agency excludes all representations, warranties, and conditions relating to our service and the use of this service.

11. Limitation of Liability

In no case shall Triad Agency, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, punitive, special, or consequential damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your use of the service.

12. Termination

We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. Upon termination, your right to use the service will cease immediately.

13. Governing Law

These Terms shall be interpreted and governed by the laws of the Netherlands, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

14. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days' notice prior to any new terms taking effect.
